RIVMA Photography Terms of Service
1. Agreement to These Terms
These Terms of Service govern all student photography services provided by RIVMA Photography, the in-house photography program of Riverside Montessori Academy ("RIVMA," "we," "us," or "our"). By submitting a photo consent form, placing an order, or allowing your child to be photographed, you (the parent or legal guardian, "you") agree to these Terms.
1.1 Who these Terms cover. These Terms apply to parents and legal guardians of enrolled RIVMA students, and to any family member who purchases photo products on a student's behalf.
1.2 In-house program. RIVMA Photography is operated by a photographer employed or engaged directly by Riverside Montessori Academy. No outside photography vendor receives student images or family contact information, except the print and fulfillment partners described in Section 3.
1.3 Changes. We may update these Terms from time to time. The current version will always be posted on the RIVMA website and available from the front office. Updates apply to sessions and orders placed after the posted effective date.
2. Photo Sessions
2.1 Services. RIVMA Photography offers individual student portraits, class group photos, and select event photography (such as graduations, performances, and seasonal celebrations). Picture day dates are announced each school year.
2.2 Scheduling. Picture days take place on campus during the school day. Dates are shared with families at least [14] days in advance through school communications. Students are photographed by classroom, following the school's normal supervision practices.
2.3 Participation is optional. No student is required to purchase photos. Class group photos and yearbook or school directory images may include all students unless a parent has opted out under Section 4.
2.4 No retakes or make-up sessions. Each picture day is a single session. We do not offer retakes, and we do not schedule make-up days for students who are absent. Students who miss picture day will not have an individual portrait for that session.
2.5 Student comfort and conduct. Our photographer will never force a student to pose. Students who are upset or unwilling will be given the chance to try again later during that same session. Posing is guided verbally, and any physical adjustment (such as straightening a collar) is made only with the student's permission and in view of school staff.
3. Orders, Payment, and Delivery
3.1 Online gallery and ordering. After each session, families receive access to a private online gallery. All ordering takes place through the RIVMA Photography online store. There is no order deadline; you may place orders at any time while your gallery is available.
3.2 Pricing. Pricing is not published in advance of picture day. Current prices for all products are listed on the online store. Prices may change over time, but the price shown at checkout is the price you pay.
3.3 Payment. Payment is due in full at checkout through the online store, using the payment methods offered there.
3.4 Delivery. Printed orders are typically delivered within [4 to 6] weeks of the order date. Digital downloads are delivered by email or through your private gallery. Delivery options and any shipping fees are shown at checkout.
3.5 Satisfaction and refunds. Because photo products are custom-made for your family, all sales are final once an order is produced. We will reprint or replace, at no cost, any order that arrives damaged, has a printing defect, or contains the wrong student's images, if reported within [30] days of delivery.
3.6 Print partners. Prints may be produced by a professional photo lab selected by RIVMA. We share only the images and information needed to fill your order, and our lab partners may not use them for any other purpose.
4. Consent, Privacy, and Use of Images
4.1 Consent choices. Each school year, parents choose from the following options on the RIVMA Photo Consent Form:
Portraits and class photos for family purchase, yearbook, and the school directory
Internal school use, such as classroom displays, parent newsletters, and the password-protected parent portal
Public promotional use, such as the RIVMA website, social media, brochures, and advertising
Full opt-out, meaning your child will not be photographed by RIVMA Photography
You may change your choices at any time by notifying the front office in writing. Changes apply going forward and cannot recall materials already printed or distributed.
4.2 Protecting student identity. In any public promotional use, we will not publish a student's full name, grade, or classroom alongside their image without separate written permission. Location data (geotags) is removed from all images before public posting.
4.3 Image storage and security. Student images are stored on RIVMA-controlled accounts and devices with access limited to authorized staff. Online galleries are private and require a unique access code or login. We retain portrait files for [3] school years to support reorders, then securely delete them unless you request earlier deletion.
4.4 No sale of data. RIVMA does not sell, rent, or share student images or family information with advertisers or third parties for their own marketing.
4.5 No use of artificial intelligence. RIVMA Photography does not use artificial intelligence (AI) to create, generate, alter, or enhance student images. Student images are never uploaded to AI tools or services, and are never used to train AI models. All editing is performed by our photographer using standard photo editing software.
4.6 Ownership and copyright. RIVMA owns the copyright to all images created by RIVMA Photography. When you purchase prints or digital files, you receive a personal-use license to view, print, and share those images with family and friends, including on personal social media. This license does not permit commercial use or resale.
4.7 Your requests. You may request a copy of your child's images, ask us to delete them, or ask us to remove a specific image from school channels by contacting us at the address in Section 5. We will respond within [30] days.
5. General Terms
5.1 Limitation of liability. If images are lost or damaged due to equipment failure, file corruption, or circumstances beyond our control, our responsibility is limited to offering a free retake or a refund of the amount paid for the affected order. We are not liable for indirect or consequential damages.
5.2 Circumstances beyond our control. If a session is canceled or delayed due to illness, weather, school closure, or similar events, we will reschedule as soon as reasonably possible.
5.3 Resolving concerns. We want every family to be happy with their photos. Please bring any concern to the front office first, and we will work with you in good faith to resolve it within [14] days.
5.4 Governing law. These Terms are governed by the laws of the State of California. Any dispute will be handled in the courts of Riverside County, California.
5.5 Severability. If any part of these Terms is found unenforceable, the remaining sections stay in effect.
